HC stays Islamic Arabic University order scrapping Fazil, Kamil madrasah committees

Staff Correspondent

The High Court on Monday stayed an administrative order cancelling the governing bodies and ad hoc committees of all Fazil and Kamil madrasahs affiliated with the Islamic Arabic University.

The court also issued a rule after a preliminary hearing on a writ petition.

A bench comprising Justice Sikder Mahmudur Razi and Justice Fatema Anwar passed the order. Advocate Parvez Hossain represented the petitioner, while Deputy Attorney General Noor Mohammad Azmi appeared for the state.

Azmi later said the state or the relevant authorities were considering filing an appeal with the Appellate Division against the stay order.

According to case documents, the university's 43rd Syndicate meeting, held on October 15, decided to dissolve the existing governing bodies and ad hoc committees of all affiliated Fazil and Kamil madrasahs nationwide.

Acting on that decision, the university's Registrar's Office issued an order on October 19, signed by Registrar Professor Dr AK Muhammad Nurul Islam. It directed the madrasahs to submit proposals for forming new ad hoc committees as soon as possible in line with government regulations.

Challenging the legality of the order, a writ petition was filed with the High Court.
The court's stay allows the existing governing bodies and ad hoc committees to continue their activities pending further proceedings.
