HC orders policy for swift transmission of bail orders

The High Court (HC) on Monday directed the authorities to formulate an effective policy for the swift transmission of bail orders issued by the HC and the Appellate Division to lower courts.

The court ordered the Registrar General of the Supreme Court (SC) to form a committee within the next seven days.

A High Court bench comprising Justice Md Habibul Gani and Justice Syed Mohammad Tazrul Hossain issued the directive.

The court also instructed the committee to submit a report to the HC Division by August 20, outlining recommendations for framing a policy to ensure the prompt transmission of bail orders.

Earlier, five Supreme Court lawyers and two lawyers from the lower courts filed a writ petition seeking such directions.

The petitioners are Md Mizanul Haque, Md Saddam Hossain, Md Abdul Wadud, Abdullah Sadiq, Zayed Bin Amjad, Sabbir Ahmed and Mahmudul Hasan.

The petition was argued by advocates Mohammad Shishir Manir, Md Saddam Hossain and Zayed Bin Amzad.

During the hearing, the petitioners cited judicial precedents and recent initiatives of the Supreme Court of India, informing the court that India has introduced a modern digital system through which bail orders issued by higher courts are transmitted directly and promptly online to the relevant courts and prisons.

They argued that introducing a similar digital mechanism in Bangladesh would help reduce unnecessary detention caused by delays in communicating bail orders.
